Rock the New Food Pyramid is a nutrition education and meal planning platform. We provide food analysis tools, meal suggestions, additive lookup tools, nutritional information, AI-powered chat assistants, community forums, and related features designed to help you make informed dietary choices based on the inverted food pyramid model. Our content is for educational purposes and does not constitute medical or dietary advice.

HIPAA Disclaimer:

Rock the New Food Pyramid and Dr. Seuzz LLC are not HIPAA-covered entities and are not business associates of any covered entity. We do not collect, store, process, or transmit Protected Health Information (PHI) as defined by the Health Insurance Portability and Accountability Act (HIPAA). Do not submit PHI, medical records, or confidential health information to this platform. Any health-related information you provide is used solely for the educational nutrition features described above.

2. AI-Powered Features & Disclaimer

Rock the New Food Pyramid uses artificial intelligence throughout the platform to provide nutrition analysis, food classification, additive lookups, meal suggestions, and interactive chat features. By using any AI-powered feature on this platform, you acknowledge and agree to the following:

AI-Powered Features Include:

• Food Pyramid Check — AI-powered food analysis and NOVA classification.
• The Dirty 25 Additive Lookup — AI-powered ingredient and additive research.
• Meal Suggestions — AI-generated recipe recommendations.
• Tetra Chat System — Our integrated chat platform, which includes:
  • Manny — A general AI nutrition assistant available to all users.
  • The Chum — Community group chat rooms organized by dietary preference (premium feature).
  • Gator — A private, one-on-one AI nutrition coach (premium feature).

Important Disclaimers:

• AI features are not medical professionals. No AI feature on this platform is a licensed doctor, dietitian, nutritionist, or healthcare provider. They cannot diagnose, treat, cure, or prevent any disease or medical condition.
• Do not rely on AI features for medical diagnoses. All information provided by AI features is for general educational and informational purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment.

3. Free Trial & Freemium Access

Rock the New Food Pyramid offers limited free access to certain features to allow users to evaluate the service before subscribing. Free trial terms include:

• Limited free uses: Non-paying users receive a limited number of free uses per feature (e.g., 3 food analyses, 3 recipe searches, 3 additive lookups). These limits may change at our discretion.
• Any attempt to circumvent, manipulate, or abuse the free trial system through technical means is a violation of these Terms and may result in immediate account suspension or termination.
• Free trial users are bound by all sections of these Terms of Service, including disclaimers, acceptable use, and limitation of liability.
• We reserve the right to modify, limit, or discontinue free trial access at any time without notice.

4. Subscription, Pricing & Auto-Renewal

• Rock the New Food Pyramid offers two subscription plans: $3.99 per month (monthly) or $39.99 per year (annual, equivalent to 2 months free).
• Your subscription begins immediately upon payment authorization and grants unlimited access to all premium features.
• Your subscription automatically renews until cancelled. You will be charged on a recurring basis at the then-current subscription rate (monthly or annually, depending on your plan) unless you cancel before the next billing date.
• Monthly billing occurs on the anniversary of your signup date. Annual billing occurs once per year on the anniversary of your signup date.
• You may cancel auto-renewal at any time through your account settings or by contacting us at support@rockthenewfoodpyramid.com. Cancellation takes effect at the end of the current billing period.
• Prices are listed in U.S. dollars and may be subject to applicable taxes.
• Third-Party Payment Processing: All payments are processed securely by Stripe, Inc., a third-party payment processor. By subscribing, you agree to Stripe's Privacy Policy and Terms of Service. Dr. Seuzz LLC does not store your full credit card number. Payment data is transmitted directly to Stripe using industry-standard encryption.

5. Cancellation Policy

You may cancel your subscription at any time from your account settings. Upon cancellation:

• You will retain access to the service until the end of your current billing period.
• No further charges will be made after cancellation.
• We do not offer partial refunds for unused portions of a billing period.

6. Billing Disputes & Resolution

Rock the New Food Pyramid is a digital subscription service.

Website Purchases:

For subscriptions purchased directly through our website, all sales are final and no refunds will be issued for partial billing periods. You may cancel at any time per Section 5 above.

App Store & Google Play Purchases:

For subscriptions purchased through the Apple App Store or Google Play Store, refunds are governed by the respective platform's refund policy. Please contact Apple or Google directly to request a refund for app store purchases. We do not control and are not responsible for refund decisions made by third-party app stores.

• Chargebacks & Disputes: If you believe a charge is unauthorized or incorrect, please contact us directly at support@rockthenewfoodpyramid.com before initiating a chargeback with your payment provider. We are committed to resolving billing issues promptly and fairly.

7. Account Responsibilities & Children's Privacy (COPPA)

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information during registration and to notify us immediately of any unauthorized use of your account.

Age Requirement: By creating an account, you represent and warrant that you are at least 13 years of age. If you are under 13, you may not create an account or use this service.

Children's Privacy (COPPA): This service is not directed to children under the age of 13. We do not knowingly collect, solicit, or retain personal information from children under 13 years of age in violation of the Children's Online Privacy Protection Act (COPPA). If we become aware that we have inadvertently collected personal information from a child under 13, we will delete that information promptly. 8. Acceptable Use

You agree not to misuse the service, including but not limited to:

• Violating any applicable laws or regulations.

9. Community Chat Conduct (The Chum)

The Chum is our community chat feature where users can participate in group conversations organized by dietary preferences. By using The Chum, you agree to the following rules of conduct:

• Be respectful. Do not harass, bully, threaten, or demean other users.
• No medical advice. Do not provide or solicit specific medical diagnoses or treatment recommendations in community chats. Encourage others to consult qualified healthcare providers.
• No spam or self-promotion. Do not post unsolicited advertisements, promotional materials, or repetitive content.
• No illegal content. Do not share content that violates applicable laws, including copyrighted material, defamatory statements, or illegal substances.
• No harmful content. Do not post content promoting eating disorders, dangerous diets, or self-harm.
• Respect privacy. Do not share other users' personal information without their consent.

We reserve the right to moderate, edit, or remove content that violates these guidelines, and to suspend or terminate the accounts of users who repeatedly violate community standards. User-generated content in The Chum reflects the views of individual users and is not endorsed or verified by Rock the New Food Pyramid or Dr. Seuzz LLC.

10. User-Generated Content License

By submitting, posting, or uploading any content to this platform — including but not limited to recipes, chat messages, product reviews, food images, or ingredient lists (collectively, "User Content") — you grant Dr. Seuzz LLC a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, display, reproduce, distribute, modify, adapt, and create derivative works from your User Content solely in connection with operating and improving the service.

• You represent that you own or have the necessary rights to submit your User Content.
• You are solely responsible for the accuracy, legality, and appropriateness of your User Content.
• This license survives termination of your account with respect to content already published or shared on the platform.
• We reserve the right to remove any User Content at our sole discretion.

11. Intellectual Property & DMCA

All content, design, graphics, and other materials on Rock the New Food Pyramid are owned by us or our licensors and are protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

User-Generated Content & Section 230

• User-generated content, including reviews, comments, and submitted recipes, reflects the views of the individual user and is not endorsed, verified, or approved by Rock the New Food Pyramid or Dr. Seuzz LLC.
• In accordance with Section 230 of the Communications Decency Act, we are not liable for content posted by users of this platform.

DMCA Takedown Procedure

If you believe that content on our platform infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include:

• Identification of the copyrighted work you claim has been infringed.
• Identification of the infringing material and its location on our platform.
• Your contact information (name, address, email, phone number).
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner.

17. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of war or terrorism, pandemics, government actions, power outages, internet or telecommunications failures, cyberattacks, third-party service provider outages, or any other event that could not have been reasonably foreseen or prevented.

In the event of a force majeure event, our obligations will be suspended for the duration of the event. We will make reasonable efforts to notify you of any significant service disruption and to resume normal operations as soon as practicable.

18. Indemnification

You agree to indemnify, defend, and hold harmless Dr. Seuzz LLC, its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms of Service;
• Your use or misuse of the service;
• Your User Content or submissions to the platform;
• Your violation of any third party's rights, including intellectual property or privacy rights;
• Any claim that your User Content caused damage to a third party.

19. California Privacy Rights (CCPA)

If you are a California resident, the California Consumer Privacy Act (CCPA) provides you with the following rights regarding your personal information:

• Right to Know: You may request disclosure of the categories and specific pieces of personal information we have collected about you.
• Right to Delete: You may request deletion of your personal information, subject to certain exceptions.

Subject to the binding arbitration clause in Section 6, any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Pasco County, Florida, and you consent to the personal jurisdiction of such courts.

21. Severability

If any provision of these Terms of Service is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect and shall not be affected by the invalidity or unenforceability of any single provision.

22. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Dr. Seuzz LLC with respect to your use of the service and supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether written or oral, relating to the subject matter of these Terms. No waiver by Dr. Seuzz LLC of any breach or default hereunder shall be deemed a waiver of any subsequent breach or default.
